What UK businesses should consider when work is delivered from India

Practical considerations covering contracts, access to personal information, working hours and governance.

Agree the contractual position first

A mutual non-disclosure agreement, a statement of work and, where personal information is involved, a data-processing agreement should be in place before access is granted.

Be specific about access to personal information

A UK organisation remains responsible for selecting a lawful arrangement for transferring or providing access to personal information. A contract alone does not make every arrangement lawful.

Set the working-hour overlap deliberately

Decide how much of the UK working day needs live cover, and write it into the scope rather than assuming it.
